GENERAL TERMS AND CONDITIONS OF SALE

  1. Data

SENSOR ID srl is an Italian company that aims to provide, mainly to companies and professionals in various sectors, products (hardware and software) and IT services. The following are the rules governing the contracts for the sale of products and services between SENSOR ID srl and the Customer. The conditions contained in this document may be modified by SENSOR ID srl without prior notice and will be valid from the date of publication on the www.sensorid.it website.

  1. Acceptance  of the General Terms and Conditions of Sale
    1. The contract stipulated between SENSOR ID srl and the Customer shall be considered concluded with the acceptance, even if only partial, of the order by SENSOR ID srl. Once the purchase procedure has been completed, as specified in Article 3 below, the Customer declares that he/she has read all the information provided to him/her and that he/she fully accepts the General Terms and Conditions of Sale as well as the payment conditions transcribed below and possibly specified at the time of acceptance of the order.
    2. The Client undertakes to print and store these General Terms and Conditions of Sale which, being an obligatory step in the purchase, will have already viewed and accepted, as well as the specifications of the product or service being purchased, and this in order to fully satisfy the conditions set out in art. 4, 5, 52 and 53 of Legislative Decree 206/2005. The Client is excluded from any right to compensation for damages or indemnity, as well as any contractual or non-contractual liability for direct or indirect damage to persons and/or property, caused by the non-acceptance, even partial, of an order, as well as for any delay not directly attributable to SENSOR ID srl.
  2. How to buy
    1. The Customer may only purchase the products and services that SENSOR ID srl has declared to be able to offer by means of an e-mail response to the relevant request made by the Customer.
    2. The request for products and services must be sent by email to the support@sensorid.it address  and  must indicate precisely the products and/or services requested. SENSOR ID srl undertakes to provide, at the Customer’s request, all the technical information relating to the product and/or service, reserving the right to reproduce those of the manufacturers of the components used for the realization of the product/service offered. It is understood that, if the above-mentioned manufacturers have not adapted their technical information (technical data sheet and image accompanying the descriptive sheet of a product or service), the technical information sent by SENSOR ID srl together with the acceptance of the order may not be perfectly representative of the characteristics of the product. In this case, SENSOR ID srl is hereby exempt from any responsibility for any differences that the customer may find between the technical data sheet indicated by the manufacturer of the component in question and the product or service physically received.
    3. By sending the order, to be made by email to the following address: support@sensorid.it  the Customer sends to SENSOR ID srl a proposal to purchase the products and/or services requested. The sending of the purchase order implies the consent to receive from SENSOR ID srl, the subsequent communications, aimed exclusively at the conclusion and execution of the sales contract.
    4. SENSOR ID srl communicates the acceptance of the purchase proposal by means of an e-mail reply, sent to the e-mail address provided by the Customer and reporting the summary data of the order placed, including the technical information sheet of the product service offered, as well as an “Order Reference Number” to be used in any subsequent communication with SENSOR ID.
    5. In any case, SENSOR ID reserves the unquestionable right to accept/not accept the customer’s purchase proposal and, in the event of non-acceptance of the order, SENSOR ID srl will promptly communicate it by e-mail to the Customer.
    6. Within 48 hours from the communication of the acceptance referred to in the previous paragraph, the Customer may, at his discretion, cancel the order by communicating his desire not to proceed with the purchase of the product/service by email to the address support@sensorid.it or by telephone to the number 0874775257. After this 48-hour period, the purchase procedure will be considered completed.
    7. By concluding the purchase procedure, the Customer declares and acknowledges that the products and/or services purchased comply with their needs and are suitable for the destination for which they are purchased.
  3. Payment Methods
    1. Payment must be made by the Client by bank transfer to the following addresses: communicated at the time of acceptance of the order.  
    2. Invoicing will take place upon delivery of the supply and/or at the end of the commissioned activity and/or at the time of activation of the software service, unless otherwise agreed upon upon acceptance of the order.
    3. Payment for the purchased product/service can be made within 30/60/90/120 from the issuance of the invoice. SENSOR ID, with the communication of acceptance of the order referred to in Article 3.4 above, indicates to the Customer the deadline, established on the basis of the characteristics of the order placed, within which the payment must be made.
    4. In any case, SENSOR ID reserves the unquestionable right to request advance payment for the product/service purchased. In this case, the order will be processed/the service will be activated only after the actual display of the credit in the bank of the requested amount.
  4. Shipping Methods 
    1. Shipments are made, on behalf of the Customer, with our affiliated express courier. SENSOR ID cannot be held responsible for any delay in the delivery of the order.
    2. The order will only be shipped when all the requested products are available. SENSOR ID, therefore, is not obliged to make partial shipments, unless this has been expressly agreed.
    3. For each order placed, SENSOR ID srl issues an invoice for the material shipped and/or the service requested, sending it by e-mail to the order holder. For the issuance of the invoice, the information provided by the Customer at the time of the order is valid.
    4. Standard delivery by express courier will take place from Monday to Friday at the following times: from 9.00 a.m. to 1.00 p.m.; from 2.00 p.m. to 6.00 p.m. The delivery of the ordered goods is intended to be on board the truck (street level), unless otherwise specified. In the event of failure to collect the material in stock at the warehouses of the courier due to repeated impossibility of delivery to the address indicated by the Customer at the time of ordering, the related products will be returned to the warehouse of SENSOR ID srl. 
    5. At the time of delivery of the goods by the courier, the Client is required to check: – that the number of packages delivered corresponds to what is indicated in the transport document; – that the packaging is intact, not damaged, nor wet or otherwise altered.

Any damage to the packaging and/or the product or the mismatch in the number of packages or indications must be immediately disputed, by affixing the words “ACCEPTED WITH RESERVATION” on the courier’s delivery receipt indicating “THE REASON” for such reservation (e.g. I accept with reservation because the package is damaged). In the event that the package is intact upon delivery, it will not be possible to sign the delivery receipt with “SUBJECT TO CONTROL”. Once the courier’s document has been signed, the Client will not be able to raise any objection about the external characteristics of what has been delivered.

The Carrier is also liable for any delay in the delivery of the goods to the recipient.

SENSOR ID srl, for the cases indicated above, must be considered exempt from any liability for loss or damage (damage) of the goods from the moment they are delivered unreservedly to the carrier for transport. Any problems relating to the physical integrity, correspondence or completeness of the products received must be reported to the courier within 8 days of delivery by registered mail with acknowledgement of receipt (Article 1698 of the Italian Civil Code). Any report after the above deadlines will not be taken into consideration. For each statement, the Client assumes full responsibility for what is declared. From the moment the Customer receives the damaged goods or requests their return to the carrier, he has a direct and exclusive action against the carrier.

  1. Shipping costs
    1. The amount of the shipping costs is determined on the basis of the size and weight of the package to be shipped and is communicated to the Customer together with the acceptance of the order.
    2. The prepayment method also involves the prepayment of shipping costs.
  2. Consumer’s right of withdrawal
    1. Pursuant to the Consumer Code implementing Directive 2011/83/EU implemented in Italy with Legislative Decree No. 21 of 21 February 2014, Customer-consumers may decide to withdraw from the purchase made, at any time and for any reason, and obtain a refund of the fees paid at the time of advance payment. The costs of sending the product from the Customer to SENSOR ID are borne by the Customer.
    2. The Professional Client and/or Companies will not be able to make use of the right of withdrawal, as it is exclusively due to the Consumer understood as a natural and not a legal person.
    3. Within 14 days from the date of delivery of the goods, in order to withdraw from the purchase, the Customer must proceed as follows:
      • send a communication of the intention to withdraw by email to the address amministrazione@sensorid.it;
      • the goods to be returned must be adequately packaged (in all cases the affixing of labels or adhesive tapes directly on the original packaging of the product must be avoided) and shipped in an insured manner, without undue delay and in any case within 14 days from the day on which the withdrawal from the contract by the Customer was communicated.
      • the goods must be sent to: SENSOR ID srl, Via Don G. Mucciardi n.5, 86020 – Campochiaro (CB)
    4. The right of withdrawal is subject to the following mandatory conditions:
      • the Client shall return the product complete with all its parts. If the product purchased and sold concerns an electronic and/or telecommunications device, it must be returned intact (unopened and with the seals intact as shipped);
      • with the opening or breaking of the seals of the packaging of the electronic and/or telecommunications device, the same can no longer be considered as new and therefore will suffer, once returned, a decrease in value at the exclusive and unquestionable judgment of the seller;
      • the returned product must bear the same serial number as on the invoice; if the serial number is different, the withdrawal will not be accepted and the product will be made available to the Customer again, without any financial refund by SENSOR ID srl to him;
      • the shipment for the return of the product is under the responsibility of the Customer, until the moment in which SENSOR ID srl confirms that it has received the product;
      • in the event that the product is damaged during its return to the warehouses, it will be the responsibility of SENSOR ID srl to communicate the incident to the Customer to allow him to file a complaint against the courier and obtain insurance reimbursement. SENSOR ID srl will immediately make the product available to the Customer, cancelling the withdrawal.
    5. SENSOR ID srl will make the refund within 14 days from the date of return of the product to its warehouses or from the date on which the Customer sends proof of the actual delivery of the goods to the courier and only if the aforementioned conditions referred to in Article 8.4 above are complied with and if the returned product and its packaging have the characteristics indicated in the same article. The refund will be made by bank transfer to the bank details communicated by the Client
    6. The right of withdrawal, even if already exercised, lapses if the customer does not return the goods to SENSOR ID within 14 days of exercising the right of withdrawal. For the purposes of the expiry of the term, the goods are considered returned when they are delivered to the carrier or forwarder.
  3.  Warranty and Assistance Conditions
    1. All products sold by SENSOR ID srl are covered by a 12-month warranty (24 months in the case of a consumer customer). In order to benefit from warranty service, the Customer must keep the invoice that he will receive by e-mail in electronic PDF format.
    2. The warranty for the products purchased is provided to the Customer following a formal notification that must be made through a specific procedure that can be activated on the website: www.support.sensorid.it, after the creation by the Customer of his own personal account. In the same way, SENSOR ID will offer technical assistance in relation to any inefficiencies related to the services and/or software sold. In any case, the Customer is required to follow the further instructions relating to the procedures for requesting assistance/warranty that may be communicated at the time of acceptance of the order and/or illustrated in the documentation inside the product packaging.
    3. Any report made in a manner other than the above will not be examined and processed by SENSOR ID.
    4. The product warranty applies to the product that has a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and the provisions of the attached technical documentation. In the event of a lack of conformity, SENSOR ID srl provides, at no cost to the Customer, to restore the conformity of the product by means of repair/replacement. If, as a result of the intervention, the defect does not turn out to be a defect in

In order to comply with the requirements, the Client will be charged for any required verification and restoration costs, transport costs, as well as general management costs with a minimum of € 50.00 plus VAT.

  1. In the event that, for any reason, it is not possible to return a product under warranty (restored or replaced) to its Customer, SENSOR ID srl may proceed at its discretion with the refund at the lower of the market value, at the time of the request, and the invoiced value; or, to its replacement with a product of equal or superior characteristics, even of a different brand.
  2. No damages can be claimed from SENSOR ID srl for any delays in carrying out repairs or replacements or for delays in IT assistance relating to a software service, unless a deadline has been expressly provided, at the time of acceptance of the order, within which such assistance must be ensured
  3. In cases where the application of the warranties provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.). The Customer is required to package the product in such a way as to avoid damage to the original packaging. In all cases, the affixing of labels or adhesive tapes directly to the original packaging of the product should be avoided.

Governing Law

The sales contract between the Client and SENSOR ID srl is intended to be concluded in Italy and governed by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Campobasso.
